  • Quartermain is subject to a legal code developed by the efforts of the Grand Council to develop a Civil system that upkeeps the founding intent of the facility without imposing unnecessary restrictions that could stifle trade or the development of understanding and peace among the many beings that live on or pass thru Quartermain's environments.

    Quartermain is institutionally a Non-profit Organization designed to be financially independent and without bias in its laws and operations. The wording of its Constitution and the body of Laws, Rules and Regulations are to protect the rights of individuals and corporate entities while refusing to become embroiled in external politics.

    Rather than reproduce the whole of the legal code here, we'll just cover a summary of a few of the important basics that may come into importance during actual game play.

    Compensation

    A large part of the settlement of criminal and civil acts under Quartermain Law has to deal with Compensation of lost assets to the victims. Exactly how this is applied is based upon the decision of the Judge presiding over the case. Compensation does not have to be in monetary funds, but may include real property, services, intellectual property or assumption of debt or responsibility. For example, someone convicted of the negligent death of a sentient who is brought to trial on behalf of the family of a deceased head of family may be required to assume the responsibilies of that deceased member in regards to the care and well being of the members of the family; or they might simply be expected to pay compensation in money for the expected earnings of the individual for the projected expected lifetime remaining to them based on their age and species. The Judge is given a large range of flexibility in regards to what is just compensation in a case, but must take into consideration the nature of the crime, severity, species involved etc.

    Death Penalty

    The Grand Council has established that the legal system will only apply death as a penalty in certain situations under Quartermain's Legal code, since the belief and need for such varies drastically between the various cultures represented on the Council. Attempted or Successful Genocide, Use of a Weapon of Mass Destruction within the Environments of Quartermain except in self-defense, Deliberate Murder of Five or more Sentient Individuals as part of a single action, Deliberate Destruction of a planet's Biosphere, Deliberate Attempt (or Successful Attempt) to extinguish a Sun or cause it to go Nova or Attempting to Destroy a T-Gate are all Death Penalty crimes.

    Imprisonment

    Imprisonment is used as a deterrment to minor criminal acts primarily in Quartermain, or for those individuals who are a threat to themselves or to the general population in the short term. Facilities for prisoners exist in the Archon and Diversity Domes. A maximum sentence to these facilities is about 90 days.

    Also used by the courts is a House Arrest system, where an individual's residence is secured and their departure is not allowed (except for court appearances or medical services under Sentinal accompaniment). The use of House Arrest may be used for periods of up to 6 months.

    Legal Representation

    Anyone accused of a crime is entitled to legal representation and for such representatives to be present during interrogations and all court procedures to protect their rights. An individual can choose to give up this right, but such must be done in the presence of such a legal representative not in the direct employ of the Guardians. A pool of Public Defenders exists, and at least one such Defender is present at the main Hall of Public Guardian Services at all times. Testimony acquired outside of such supervised interrogations cannot be used in evidence. Individuals can bring in outside Legal representatives to replace a Public Defender, or request specifically a Public Defender of their own Species be assigned to them from the court. Victims of Crime may also request a Public Champion to represent them in court or may hire their own outside Champions to file any and all briefs and necessary forms.

    Legal Rights Of Individuals

    The Quartermain Constitution guarentees any living sentient, no matter what their place of origin, species, culture, religion, financial status or social status specific rights and freedoms while present on Quartermain. This includes Freedom of Legal Representation if accused of a crime or a victim of a crime occuring on Quartermain;
    Major Crimes
    A Major Crime is one that, if guilt is found, includes penalties such as Imprisonment or Banishment from Quartermain. Ambassadors and others with Diplomatic Immunity are not immune to prosecution for such crimes. These include Arson, Pre-Meditated Murder, Embezzlement, Fraud or Theft in excess of One Million Qs Value, Armed Robbery, Rape, Enslavement of Legally Free Entity Against their Will, Torture of a Non-Consenting Sentient, etc. All Crimes to which a Death Penalty can be applied are also considered to be Major Crimes.
    Minor Crimes
    A Minor crime is one the penalty for, if guilt is found, is primarily Compensation of an offended party, public admonishment, loss of license, loss of privilages or rights. Ambassadors and others with Diplomatic Immunity are immune to most Minor Crime penalties, except for admonishment or compensation of an offended party.
    Public Champion
    A Legal representative for someone filing a criminal complaint, appointed by the Public Guardian Services. These can also be replaced by a Private Champion, a lawyer hired to hold the same function. Public Champions are paid for from the Quartermain Legal Aid Fund.
    Public Defender
    A Legal representative assigned to an individual being officially interrogated or accused of a crime who must be present at all interrogations and legal procedings. These are appointed from a government pool and serve the interests of the accused or witness involved ; or may be externally hired by an individual with such needs (and then called a Private Defender). Public Defenders are paid for from the Quartermain Legal Aid Fund.
    Public Guardian
    A Public Guardian is a duly appointed and trained member of one of Quartermain's non-uniformed public service professionals who uphold the laws, rules and regulations of Quartermain and assist in maintaining the peace, safety and harmony of its environments. Guardians are used for both public and undercover work, and have permits for concealed weaponry. Guardians are not allowed to gamble, accept gifts from non-relatives, acquire loans except from the Guardians Credit Trust, or utilize intoxicants or other performance reducing liquids, foods and medications while on duty. Guardians are expected to risk their lives if necessary to perform their jobs. There are only a small number of Guardians on staff, working in small Teams of 4 to 8 individuals. Teams have a Team Coordinator, and answer to the Guardian Director.
    Public Sentinal
    Uniformed Public Service Professionals who act as guards, harmony enforcers and safety assistance in all Quartermain Public areas and buildings. Sentinals are not allowed to gamble, accept gifts from non-relatives, acquire loans except from the Sentinals Credit Trust, or utilize intoxicants or other performance reducing liquids, foods and medications while on duty. Sentinals are out-ranked by Guardians and may be assigned to assist them on specific situations. Sentinals are not required to risk their lives in performing their jobs. There is a large force of Sentinals, with an Officer over units of 10 individuals and a Commander over every 10 Officers who answers to the Guardian Director. Also Called Security Officers.
    Public Witness
    Public Witnesses were originally added to the legal system after encountering them among the humans. The requirements for the position thus were created from those used in that culture, and so many are from that racial stock. Among humans they are all Hyperions, and these are the only Hyperions allowed to stay on Earth under its laws regarding racial purity.

    All Public Witnesses have Metal Awareness (See the Rules Page 106), Eidetic Memory See the Rules Page 64) and a Mental Defense of 30 or better (See the Rules Page 129). Several races with Espers that fit these needs do exist and may also be found serving as Public Witnesses. A Public Witness is trained in reporting what they observe, acting like an old fashioned Notary Public but with expanded duties that include both Civil and Criminal Court usage for presentation of facts and events. They are generally considered tamper proof in regards to Other Espers, more reliable then any mechanic form of recording device (since cameras and such are easily tampered with) and highly regarded regarding their honesty and ability to notice details. It is generally said that "A Public Witness does not Lie", because to do such would be the death of their career (and they are well paid when working for the government or for private firm commissions). One known case exists on Earth of a Public Witness that lied in court, that witnes was lynched by a mob when the lie was exposed.

    Right To Die

    An individual has the right under Quartermain Law to die and do so with dignity as they so choose, and cannot be kept alive against their will by members of the medical profession. If they require assistance to achieve this they may ask for such with a Public Witness present and receive such aid from a medical professional.

    Sanctuary

    Quartermain is Neutral Territory under it's Constitution and is not required to extradite refugees, escaped slaves, or ordinary criminals to other civilizations. Everyone basically has sanctuary here, and only the Grand Council may force the extradition of an individual to another civilization for actions outside of Quartermain's system. The Quartermain Courts may only deal with crimes committed within the solar system that Quartermain lies within, it has no jurisdiction over activities outside said territory, but the courts will use banishment from Quartermain (temporary or permanent) as a punishment for Major Crimes. The Grand Council, with a 2/3 members approval vote can extradite individuals or revoke Sanctuary rights, but such events are rare.

    Of course this means that Quartermain is often a port of last resort for miscreants, wanderers and outcasts of other worlds.

    Self Defense, Right Of
    Any sentient individual has the right to protect themselves from obvious direct physical harm by any means available to them, even if such defense includes the use of potential lethal force. Individuals are allowed to carry unconcealed weaponry, protective devices and apparel (Concealed weaponry requires a permit to be purchased and a record of the weapon filed with the Hall of Public Guardian Services. This permit can be denied based on previous criminal record, mental instability or obvious intent of use for criminal activity.) This Right does not apply to Weapons of Mass Destruction.
    Telepathic Evidence :
    Telepathic Evidence is not admissible in court as proof of guilt or innocence. Confessions gained thru Telepathic Intrusion or Force (including Hypnotism and Mind Control Techniques via non-Esper Means) are unacceptable in Court. Use of Telepathy for Lie Detection during Interrogation is not allowed under the code of Justice.

    Tampering with a Witness, Judge or Jury Member thru Telepathic or Mind Control methods is a crime and punishable under the legal code.

    Torture :

    Physical or Mental Torture cannot be used to acquire testimony, confessions or evidence. Anyone accused of a crime is entitled to legal representation and for such representatives to be present during interrogations and all court procedures to protect their rights.     Use of Excessive Force
    Weapons Banned
    Quartermain specifically bans the possession, storage or sale of any mobile weapon of mass destruction within its environs or upon vessels using it's docking facilities. A weapon of Mass destruction is any weapon capable of affecting a Decameter Area (10 Hex Radius) or larger with a single usage that causes physical harm. This includes explosives, radioactive destructive devices, cellular disruption, chemical weapons, bio-toxins, destructive nano-technology, energy weapons etc. If a weapon affects that large an area or larger and does Body it counts as a weapon of mass destruction. Great effort is made at the Space Platform to detect and prevent the arrival of any and all such weapons at Quartermain.

    Ship mounted weapons of mass destruction are required to be noted in the ship's registry information before being allowed to dock. Inspections are made by docking personnel (always including a Public Witness) to verify the type and status of such registered weapons. Any vessel that violates these rules and fails to report its weapons may be subject to seizure for the weapons to be impounded or made inoperable while using the facilities. Any vessel that attempts to use its weapons for violence while within Quartermain's system will face retaliation from the system defense grid, patrol vessels and possible destruction (and certainly revokation of access to the Neutral territory that Quartermain represents). Warships may pass thru Quartermain space, but are not allowed to carry out conflict in it's system.

    Vessels are not allowed to dock or remain in the system that are carrying Anti-Matter warheads or Thermonuclear weapons of any kind.
